The Form 2 Disclosure Statement is a prescribed statutory document that sellers must provide to buyers before the buyer signs a contract of sale. It replaced the previous regime where sellers only had to disclose certain matters at settlement.
The Form 2 requires sellers to disclose material facts about the property including outstanding rates and charges, any notices from council or a government body, encumbrances on the title, body corporate information (if applicable), any pool compliance certificates and information about contamination or underground tanks.
